# Términos de Servicio

## 1. Descripción del servicio

Noetia es una plataforma de expresión intelectual que combina lectura sincronizada texto-audio, captura de ideas mediante fragmentos y compartición de conocimiento en redes sociales. A través de la interacción con los libros, Noetia construye un perfil de lector que refleja el gusto intelectual de cada usuario y ayuda a conectar obras con las audiencias que más las valorarán.

El servicio está disponible en web (noetia.app) y en aplicaciones móviles para iOS y Android.

## 2. Elegibilidad

Debes tener al menos **18 años** para crear una cuenta y utilizar Noetia. Al registrarte, declaras que cumples este requisito.

## 3. Planes de suscripción, tokens y facturación

### Tokens de acceso a contenido

Cada plan incluye tokens mensuales que se canjean para acceder a libros individuales. Los tokens adicionales pueden adquirirse por separado. Los tokens tienen una vigencia de **90 días** desde su emisión; los tokens no utilizados caducan al finalizar este período.

### Condiciones generales de facturación

- Los pagos se procesan a través de **Stripe**.
- La suscripción se renueva automáticamente al final de cada período, salvo que la canceles antes.
- **Prueba gratuita**: cuando esté disponible, se especificará en el momento de la suscripción.
- **Cancelación**: puedes cancelar en cualquier momento desde tu configuración de cuenta. La cancelación surte efecto al final del período de facturación en curso; no se aplican reembolsos parciales.
- **Cambio de plan**: los cambios de plan (ascenso o descenso) entran en vigor al inicio del siguiente ciclo de facturación.
- **Reembolsos**: se considerarán reembolsos en caso de fallo técnico demostrado imputable a Noetia. Para solicitudes, escribe a **legal@noetia.app**.

### Causas Noetia

El **2,22 % de cada pago** se destina automáticamente a causas sociales y medioambientales seleccionadas por Noetia. Al suscribirte, autorizas esta distribución.

## 4. Restricciones de contenido (DRM)

Todo el contenido disponible en Noetia (libros, audios) está protegido por derechos de autor. Queda expresamente prohibido:

- Descargar, copiar o redistribuir el contenido fuera de los mecanismos autorizados por la plataforma.
- Eludir las medidas de protección técnica (DRM).
- Compartir credenciales de cuenta (cada miembro de un plan Dúo o Familia debe tener su propio perfil).

El incumplimiento puede resultar en la suspensión inmediata de la cuenta sin reembolso.

## 5. Fragmentos, contenido generado por el usuario y análisis temático

Los fragmentos (highlights) que guardas son extraídos de obras protegidas. Al usar la función de fragmentos y compartición:

- **Tú conservas** la autoría de las notas y anotaciones que añades.
- **Concedes a Noetia** una licencia no exclusiva, mundial y sin royalties para renderizar tus fragmentos como tarjetas visuales y mostrártelas a ti y a las personas con quienes elijas compartirlas.
- **Análisis temático automático**: Noetia asigna etiquetas temáticas automáticas a tus fragmentos (p. ej. "amor", "filosofía") con el fin de construir tu perfil de lector. Consulta la Política de Privacidad para más detalles y opciones de opt-out.
- Eres responsable de que el uso compartido sea personal y no comercial.

## 6. Perfil de lector y análisis de audiencia

Noetia infiere un perfil de lector a partir de tu actividad agregada. Este perfil se usa para personalización y para análisis de audiencia internos. Los autores solo acceden a estadísticas agregadas — nunca a datos individuales identificables. Puedes desactivar este análisis desde **Perfil → Privacidad → Contribuir a Noetia Insights**.

## 7. Clubes de Lectura

Al unirte a un club de lectura:

- Aceptas las normas de conducta establecidas por el moderador del club.
- Noetia puede suspender o eliminar cualquier contenido que infrinja estos términos.
- Los clubes privados limitan el acceso a los miembros aprobados; no garantizamos la confidencialidad de los mensajes publicados entre miembros.

## 8. Propiedad intelectual

La plataforma Noetia, su diseño, código, marca y materiales propios son propiedad exclusiva de Carloskfe / Noetia. Queda prohibida su reproducción sin autorización expresa.

Los libros y audios disponibles pertenecen a sus respectivos autores y editoriales, que han licenciado su contenido a Noetia. La biblioteca pública (dominio público) se ofrece de buena fe bajo licencias abiertas compatibles.

## 9. Exención de garantías

EL SERVICIO SE PROPORCIONA "TAL CUAL" Y "SEGÚN DISPONIBILIDAD". NOETIA NO GARANTIZA QUE EL SERVICIO SEA ININTERRUMPIDO, LIBRE DE ERRORES O COMPLETAMENTE SEGURO.

## 10. Limitación de responsabilidad

EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE, NOETIA NO SERÁ RESPONSABLE DE DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES O CONSECUENTES. LA RESPONSABILIDAD TOTAL DE NOETIA NO SUPERARÁ EL IMPORTE PAGADO POR EL USUARIO EN LOS ÚLTIMOS 12 MESES.

## 11. Ley aplicable y jurisdicción

Estos términos se rigen por la ley española. Cualquier disputa se someterá a los tribunales competentes de España, salvo que la legislación aplicable en tu país de residencia establezca otra jurisdicción obligatoria.

## 1. Service Description

Noetia is an intellectual expression platform that combines synchronised text-and-audio reading, idea capture through fragments, and knowledge sharing on social networks. Through interaction with books, Noetia builds a reader profile that reflects each user's intellectual taste and helps connect works with the audiences that will value them most.

The service is available on the web (noetia.app) and as mobile apps for iOS and Android.

## 2. Eligibility

You must be at least **18 years old** to create an account and use Noetia. By registering, you confirm that you meet this requirement.

## 3. Subscription Plans, Tokens, and Billing

### Content Access Tokens

Each plan includes monthly tokens that are redeemed to access individual books. Additional tokens may be purchased separately. Tokens are valid for **90 days** from issuance; unused tokens expire at the end of this period.

### General Billing Terms

- Payments are processed through **Stripe**.
- Subscriptions renew automatically at the end of each period unless you cancel beforehand.
- **Free trial**: when available, terms will be specified at the time of subscription.
- **Cancellation**: you may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; partial refunds are not issued.
- **Plan changes**: upgrades or downgrades take effect at the start of the next billing cycle.
- **Refunds**: refunds will be considered in the event of a proven technical failure attributable to Noetia. Submit requests to **legal@noetia.app**.

### Noetia Causas

**2.22% of every payment** is automatically allocated to social and environmental causes selected by Noetia. By subscribing, you authorise this distribution.

## 4. Content Restrictions (DRM)

All content available on Noetia (books, audio) is protected by copyright. The following are expressly prohibited:

- Downloading, copying, or redistributing content outside the mechanisms authorised by the platform.
- Circumventing technical protection measures (DRM).
- Sharing account credentials (each member of a Duo or Family plan must have their own profile).

Violations may result in immediate account suspension without refund.

## 5. Fragments, User-Generated Content, and Theme Analysis

The fragments (highlights) you save are extracted from protected works. When using the fragments and sharing features:

- **You retain** authorship of the notes and annotations you add.
- **You grant Noetia** a non-exclusive, worldwide, royalty-free licence to render your fragments as visual quote cards and display them to you and the people you choose to share them with.
- **Automatic theme analysis**: Noetia assigns automatic thematic tags to your fragments (e.g. "love", "philosophy") to build your reader profile. See the Privacy Policy for details and opt-out options.
- You are responsible for ensuring that sharing is personal and non-commercial.

## 6. Reader Profile and Audience Analysis

Noetia infers a reader profile from your aggregated activity. This profile is used for personalisation and internal audience analysis. Authors only access aggregate statistics — never individually identifiable data. You may disable this analysis from **Profile → Privacy → Contribute to Noetia Insights**.

## 7. Reading Clubs

By joining a reading club:

- You agree to the code of conduct established by the club moderator.
- Noetia may suspend or remove any content that violates these terms.
- Private clubs restrict access to approved members; we do not guarantee the confidentiality of messages posted among members.

## 8. Intellectual Property

The Noetia platform, its design, code, brand, and original materials are the exclusive property of Carloskfe / Noetia. Reproduction without express authorisation is prohibited.

Books and audio available on the platform belong to their respective authors and publishers, who have licensed their content to Noetia. The public library (public domain) is offered in good faith under compatible open licences.

## 9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". NOETIA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

## 10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOETIA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. NOETIA'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE USER IN THE PRECEDING 12 MONTHS.

## 11. Governing Law and Jurisdiction

These terms are governed by Spanish law. Any dispute shall be submitted to the competent courts of Spain, unless applicable law in your country of residence mandates a different jurisdiction.
